1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the BeCute website at becute.app and mobile application (collectively, the "Service"), operated by Oleksandr Padura ("we," "us," or "our"), an individual based in Ukraine.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you are strictly prohibited from using the Service.

3. Not Medical or Professional Advice

THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

BeCute is NOT a medical service, healthcare provider, licensed dietitian, nutritionist, or medical professional. The Service does not provide medical advice, diagnosis, treatment, or any form of professional health consultation.

All content provided through the Service - including but not limited to meal plans, nutrition suggestions, calorie tracking, dietary recommendations, health tips, and any other information - is for general informational purposes only and should NOT be considered a substitute for professional medical advice, diagnosis, or treatment.

You should ALWAYS consult with a qualified healthcare professional, physician, registered dietitian, or other appropriate medical professional before:

• Starting any diet, meal plan, or nutrition program
• Making any changes to your existing diet or eating habits
• Making any health-related decisions based on information from the Service
• Using the Service if you have any medical condition, food allergy, eating disorder, or health concern

We make no representations or warranties regarding the accuracy, completeness, suitability, or applicability of any nutritional information, meal plans, or suggestions provided through the Service. Individual nutritional needs vary significantly based on age, sex, health status, activity level, medical conditions, and other factors that the Service cannot fully account for.

4. Assumption of Risk

YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

You acknowledge and agree that:

• You are solely responsible for any decisions you make based on information provided by the Service
• You are solely responsible for your own health, dietary choices, and well-being
• The Service may contain errors, inaccuracies, or omissions in nutritional information, calorie counts, ingredient data, or meal suggestions
• Following any meal plan, dietary suggestion, or recommendation from the Service could result in adverse health effects, allergic reactions, nutritional deficiencies, or other harm
• You will not rely on the Service as your sole source of nutritional or health information
• You assume full responsibility for any consequences arising from your use of the Service, including but not limited to physical harm, health complications, or any other damages

5. Accounts and Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account at any time, for any reason, without prior notice.

6. Subscription and Payments

BeCute is currently free during our early access period. All features are available at no cost. When we introduce paid plans in the future, the following terms will apply:

• We will notify all users well in advance before introducing any paid subscription plans
• A generous free tier will always remain available
• If you subscribe to a paid plan, it will automatically renew each month unless you cancel before the renewal date
• You may cancel your subscription at any time through your account settings; the cancellation will take effect at the end of the current billing period
• We reserve the right to change subscription pricing with prior notice; continued use after a price change constitutes acceptance of the new price

All payments are non-refundable except where required by applicable law. We do not provide refunds or credits for partial subscription periods.

7. User Content and Data

You retain ownership of any content and data you submit to the Service (such as meal logs, health data, and profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.

You are solely responsible for the accuracy and completeness of any information you provide. We are not responsible for any consequences resulting from inaccurate, incomplete, or misleading information you submit.

8. Intellectual Property

All content, features, and functionality of the Service - including but not limited to text, graphics, logos, icons, images, audio, software, and design - are the exclusive property of BeCute and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service, other user accounts, or our systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, timely, secure, or error-free
• That the results obtained from the Service will be accurate, reliable, or complete
• That any nutritional information, meal plans, calorie data, or health suggestions are accurate, safe, or appropriate for your individual needs
• That the Service will meet your requirements or expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BECUTE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Personal injury or health complications
• Adverse reactions to foods, meal plans, or dietary suggestions
• Allergic reactions or nutritional deficiencies
• Any physical or psychological harm
• Damages arising from reliance on information provided by the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BeCute and its operator from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any health-related consequences arising from your use of the Service or reliance on its content

13. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability to you. We do not guarantee that the Service will be available at all times.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the competent courts of Ukraine.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeCute regarding your use of the Service and supersede all prior agreements and understandings.
